Partner Carl Mueller and the Mueller Christensen LLP team secured a trial court victory in California civil litigation, defeating a $1,000,000 claim through a successful Anti-SLAPP motion.

The court held that the alleged conduct arose from protected litigation activity under California’s Anti-SLAPP statute (Code of Civil Procedure § 425.16) and was independently barred by the litigation privilege (Civil Code § 47(b)). The court also struck the malicious prosecution claim, finding no favorable termination where the underlying action remains pending.

Both causes of action were dismissed, and the ruling confirmed the right to recover attorneys’ fees under § 425.16(c)(1).

This result highlights the strength of California Anti-SLAPP protections in defending against claims arising from litigation-related conduct.
